Terms of Service

These Terms of Service ("Terms") govern your use of Vibed's website design and development services. By engaging our services, you agree to be bound by these Terms.

1. Services

Vibed provides custom website design and development services for businesses. Our services include:

  • Custom website design and development
  • Domain registration and setup
  • Website hosting
  • SSL certificate installation
  • Search engine optimization (SEO) foundation
  • Ongoing support and maintenance (Care Plan)

2. Pricing and Payment

Website Package

Our standard website package is priced at £595. This is a one-time payment that includes the design, development, and launch of your website.

Care Plan

The optional Care Plan is £75 per month and includes hosting, updates, priority support, and ongoing SEO optimization. The Care Plan is billed monthly and can be cancelled with 30 days notice.

Payment Terms

Full payment is required before the website goes live. We accept bank transfer and major credit/debit cards.

3. Project Timeline

We aim to deliver your website within 48 hours of receiving all required content and approvals. This timeline assumes:

  • Prompt response to our discovery call request
  • Timely provision of content, images, and branding materials
  • Quick feedback during the review phase

Delays in providing content or feedback may extend the delivery timeline.

4. Revisions

Our standard package includes two rounds of revisions. Additional revisions beyond this may incur extra charges, which will be agreed upon before work commences.

Revisions must be requested within 14 days of the initial design presentation. After this period, changes may be subject to additional fees.

5. Client Responsibilities

You agree to:

  • Provide accurate and complete information about your business
  • Supply all necessary content, images, and branding materials in a timely manner
  • Respond to requests for feedback and approvals promptly
  • Ensure you have the rights to use any content or images you provide
  • Review and approve the final website before launch

6. Intellectual Property

Your Content

You retain ownership of all content, images, and branding materials you provide to us. You grant us a license to use this content solely for the purpose of creating and maintaining your website.

Website Ownership

Upon full payment, you own the custom design and content of your website. However, certain elements such as third-party plugins, fonts, and stock images may be subject to their own licensing terms.

Portfolio Rights

We reserve the right to display your website in our portfolio and marketing materials unless you specifically request otherwise in writing.

7. Hosting and Maintenance

If you subscribe to our Care Plan, we will host and maintain your website. This includes:

  • Secure, reliable hosting
  • Regular backups
  • Security updates and monitoring
  • Minor content updates (subject to fair use)
  • Priority support

If you choose not to subscribe to the Care Plan, you will be responsible for arranging your own hosting and maintenance.

8. Limitation of Liability

To the maximum extent permitted by law, Vibed shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities.

Our total liability for any claim arising from our services shall not exceed the amount you paid for those services.

9. Termination

Project Cancellation

If you wish to cancel a project before completion, any work completed up to that point will be billed. Deposits are non-refundable.

Care Plan Cancellation

You may cancel the Care Plan at any time with 30 days written notice. Upon cancellation, we will provide you with a copy of your website files to transfer to another host.

10. Governing Law

These Terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

11. Changes to Terms

We reserve the right to update these Terms at any time. We will notify you of any material changes by posting the new Terms on our website. Your continued use of our services after such changes constitutes acceptance of the updated Terms.
